Ellianos, LLC (together with its affiliates, “Ellianos”) is committed to respecting your privacy. This Privacy Policy describes how we collect, use, disclose, store, or otherwise process information we receive through our website (https://www.ellianos.com/), our online ordering platform (https://order.ellianos.com/), our rewards and gift card programs, our franchise locations, and any other online or offline services we offer (collectively, the “Services”). This policy also describes your choices about the collection and use of your information.
Please read our Terms of Use (“Terms”) and this Privacy Policy carefully before you start to use our Services. By using the Services, you acknowledge that you have read, understood, and agree to be bound and abide by our posted Terms and Privacy Policy. If you do not agree to both the Terms and our Privacy Policy, or if you violate them in any way, your right to access or use the Services is terminated.
1. How We Collect Information
We may collect information about you by various means, including:
- Directly from you, both online (e.g., website, email, online ordering, rewards enrollment) and offline (e.g., at franchise locations);
- Through our Services, including our website, online ordering platform, rewards program, and gift card program;
- Through automated technologies such as cookies, pixels, and similar digital tools (described in Section 3);
- From other third-party sources and social media platforms that you may use to engage with us, as well as from partners or third parties we work with; and
- By combining information from different sources, including online and offline data.
2. Types of Information We Collect
In order to better provide you with our Services, we may collect the following categories of information:
Profile and account information such as your name, mailing address, email address, phone number, date of birth, and other information you may provide to us when creating an account, enrolling in our rewards program, or otherwise using the Services;
Transactional information including payment information, order history, purchase amounts, and shopping preferences. Where we provide the ability to make purchases through the Services (including online ordering, gift cards, and merchandise), we only use your payment information as necessary to process charges and credits;
Rewards and loyalty information including points balances, redemption history, visit frequency, and preferences collected through our rewards program;
Gift card information including card balances, transaction history, and account details associated with our gift card program;
Location information such as the franchise location you visit, your delivery address for online orders, or device-based location data, including precise geolocation data, where you choose to provide it;
Survey information in response to questions we may send you through the Services, including for feedback and research purposes;
Communications between you and us, such as via email, web form, mail, phone, social media, or other channels;
Offline activity you engage in with us (e.g., purchases and interactions at franchise locations); and
Online User Activity as described in the next section.
If you provide us with information regarding another individual, you represent that you have that person’s consent to give us his or her information and to permit us to use the information in accordance with this policy.
3. Online User Activity, Cookies, and Information Collected by Other Automated Means
We may collect technical information about visitors to our Services (“Online User Activity”) through cookies and other technology. We, our service providers, and our business partners may employ cookies and the other technologies described below to remember you when you return to our Services, collect information about how our Services are used, review website traffic patterns, improve the Services, and determine what Services are popular.
Cookies are a commonly used web technology that allows websites to store and retrieve certain information on a user’s browser and track certain online activities.
Clear GIFs (also called “pixels,” “web bugs,” or “web beacons”) are small transparent images placed on a web page or in an email message to monitor user behavior, deliver cookies, collect information, count visits, understand usage and campaign effectiveness, and detect if a recipient has opened and acted upon an email.
Other technologies include Local Storage Objects (LSOs), software development kits (SDKs), and similar tools which can store content information and preferences on a user’s device.
These tools can enable us to collect information such as:
Usage Details about your interaction with our Services (such as the date, time, and length of visits, specific pages or content accessed during visits, search terms, frequency of visits, and referring website addresses);
Device Information including the IP address and other details of a device that you use to connect with our Services (such as device type and unique device identifier, operating system, browser type, mobile network information, and the device’s telephone number); and
Location Information where you choose to provide us with information about your device’s location.
Third-Party Analytics and Advertising
We use third-party analytics services to help us understand how users interact with our Services. These services may use cookies and similar technologies to collect information about your use of our Services and other websites. We also use advertising platforms, including social media platforms, to deliver targeted advertisements. These platforms may collect information about your online activities over time and across different websites and services.
Global Privacy Control
We recognize Global Privacy Control (GPC) signals. If your browser or device transmits a GPC signal, we will treat that signal as a valid request to opt out of the sale or sharing of your personal information associated with that browser or device.
4. How We Use Information We Collect
We may use the information that we obtain about you for purposes allowed by applicable laws, including:
- Provide our Services to you, process your orders and transactions, and respond to your inquiries and other communications;
- Manage your rewards account, process points, and deliver program benefits;
- Process gift card purchases, loads, and redemptions;
- Tailor the content that we display to you in our Services and communications, including advertising;
- Operate, evaluate, and improve our Services, including to diagnose or fix technology problems;
- Monitor the performance of our Services;
- Provide you with administrative notices;
- Protect against, identify, and prevent fraud, security threats, and other unlawful activity; and
- Comply with and enforce applicable legal requirements, industry standards, our policies, and our contractual rights.
5. Online Advertising
You may see us promoted by other organizations on various websites, web pages, social media, and other platforms. We may serve advertisements, and allow third parties to serve advertisements, through our Services. Advertisements served through our Services may be targeted to users who fit a certain general profile category, which may be inferred from information that you provide to us, based on your website usage patterns, or based on your activity on other websites or online services.
6. How We Share Your Information
We may share your personal information with third parties in the following circumstances:
Service Providers. We may share your information as permitted by law with service providers that we believe need the information to perform a technology, business, or other professional function for us. These include IT services, website hosting, online ordering services, payment processors, gift card and rewards program operators, marketing and advertising platforms, including social media platforms, analytics providers, print-on-demand services, and other service providers.
Franchisees. Ellianos Coffee locations may be owned and operated by independent franchisees. We may share certain personal information with our franchisees and store operators when reasonably necessary to provide services to you, fulfill orders, process payments or gift card/rewards activity, respond to customer service inquiries, support local promotions, analyze store performance, maintain brand standards, and operate our business. Franchisees may also collect personal information directly from you when you interact with a local store, participate in a locally managed promotion, or otherwise communicate with that location. Franchisees are responsible for their own privacy practices where they collect or use information independently.
User Content. If you voluntarily share or submit any User Content including contact information or content or commentary for posting through our Services, or link it to any social media platforms, that post and any information associated with it may become available to the public.
Legal and Safety. We may also disclose information about you: (i) if we are required to do so by law or legal process; (ii)when we believe disclosure is necessary to prevent harm or financial loss; (iii) in connection with an investigation of suspected or actual fraudulent or illegal activity; or (iv) under exigent circumstances to protect the personal safety of our staff, users, or the public.
Business Transfers. We reserve the right to transfer the information that we maintain in the event that we sell or transfer all or a portion of our business or assets.
7. Your Privacy Choices
Marketing Emails: You may choose not to receive marketing emails from us by clicking on the unsubscribe link in the marketing emails you receive from us. Even if you opt out, we may continue sending you non-marketing email communications such as administrative or transaction alerts.
Cookies: Web browsers may offer users the ability to disable receiving certain types of cookies. You may also opt out of certain third-party advertising cookies by visiting the Digital Advertising Alliance’s opt-out page at www.aboutads.info/choices or the Network Advertising Initiative’s opt-out page at www.networkadvertising.org/choices.
Rewards Program: You may update your preferences or close your rewards account by contacting us at privacy@ellianos.com or through your account settings.
8. Your Privacy Rights
Depending on where you reside, you may have additional rights under state privacy laws. These rights may include:
- Right to Know and Access. You have the right to confirm whether we are processing your personal information and to access that information.
- Right to Delete. You have the right to request that we delete personal information we have collected from you, subject to certain exceptions.
- Right to Correct. You have the right to request that we correct inaccurate personal information we maintain about you.
- Right to Opt Out of Targeted Advertising or Sale . You have the right to opt out of “targeted advertising” or the “sale” of your personal information. To opt out of these practices, you may either please select “decline” on the cookie banner, or enable Global Privacy Control (GPC) in your browser.
- Right to Non-Discrimination. We will not discriminate against you for exercising your privacy rights.
To exercise your rights, please contact us at privacy@ellianos.com. We will verify your identity before processing your request. If we cannot verify your identity, we may deny your request in whole or in part. You may also designate an authorized agent to make a request on your behalf.
If we deny your request, you have the right to appeal that decision. To do so, please send an email to privacy@ellianos.com with the word “Appeal” in the subject line.
9. Data Retention
We retain personal information for as long as reasonably necessary to fulfill the purposes for which it was collected, maintain your account, comply with our legal obligations, resolve disputes, and enforce our agreements.
10. Franchisee Activities
Specific franchisee locations (or groups of locations) may offer loyalty programs or other promotions or services and may collect your personal information in connection with those activities. Please note that such activities can be specific to those franchisee(s) and will be governed by the information and any privacy policy they provide to you at those locations or through other means they make available.
11. Links to Other Websites and Third-Party Content
Our Services may contain links to other websites or apps, including our online ordering platform, franchise information site, social media pages, and other third-party services. We are not responsible for the content or privacy practices of such other websites or apps, and we encourage you to read the privacy statements of any other website or app that collects personal information.
12. How We Protect Information
We endeavor to maintain reasonable administrative, technical, and physical safeguards designed to protect the personal information that we maintain against accidental, unlawful, or unauthorized destruction, loss, alteration, access, disclosure, or use. However, we cannot ensure the security of any information that you transmit to us or guarantee that this information will not be accessed, disclosed, altered, or destroyed.
13. Children
The Services are intended for use only by persons over the age of 16. We do not knowingly collect personal information from children under the age of 16. If we learn that we have collected personal information from a child under the age of 16 without appropriate consent, we will take steps to delete that information promptly. 14. Updates to Our Privacy Policy
We may revise the information on the Services or otherwise change or update the Services, including this Privacy Policy. When we update this Privacy Policy, we will update the date at the top of the policy. If we make material changes, we will provide notice consistent with applicable laws. Changes will become effective when posted. Your continued use of the Services after an update constitutes agreement to the policy as revised.
